Terms of Service

These Terms govern your access to and use of GenImage. Please read them carefully — by using the Service you agree to be bound by them.

GenImage (“GenImage”, “we”, “our”, or “us”) provides an online platform for generating images and videos using artificial intelligence (the “Service”). By accessing or using the Service at genimage.art or any associated application, you (“you” or the “user”) agree to comply with and be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and Children’s Privacy

The Service is not directed to and may not be used by anyone under the age of 13. We do not knowingly collect personal information from children under 13. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. If you believe a child has provided us with personal information, please contact us at support@genimage.art and we will take steps to delete it.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorized use of your account.

Communications. By creating an account, you consent to receive emails from us, including transactional messages relating to your account, security, purchases, and the operation of the Service, as well as product updates, newsletters, and marketing or promotional communications. Transactional and service emails are a necessary part of the Service and are sent while your account is active. To opt out of marketing or promotional emails, email us at support@genimage.art — or reply to any such email — with a request to unsubscribe, and we will action your request within a reasonable time.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. Without limiting that policy, you shall not:

  • Generate, upload, or distribute content that is illegal, infringing, deceptive, harassing, or that violates any third-party rights;
  • Create sexual content involving real, identifiable individuals without consent, or any content that sexualizes minors;
  • Attempt to reverse engineer, decompile, disassemble, scrape, or otherwise derive the source code or underlying models of the Service;
  • Resell, sublicense, or provide the Service to third parties except as expressly permitted;
  • Introduce malware, attempt to gain unauthorized access to our systems, or interfere with the integrity or performance of the Service.

5. Content Ownership and License

Your input.You retain ownership of the prompts, reference images, and other materials you submit to the Service (“Input”). You represent that you have the necessary rights to submit your Input.

Generated content.Subject to your compliance with these Terms and full payment of any applicable fees, you own the images and videos you generate with the Service (“Output”), including the right to use them for commercial purposes, to the maximum extent permitted by applicable law.

Your responsibility. Because AI models may produce similar outputs for different users and cannot guarantee originality, you are solely responsible for ensuring that your use of any Output does not infringe the rights of, or otherwise harm, any third party. We make no representation that Output is free of third-party rights.

License to us. You grant us a limited license to host, process, and transmit your Input and Output solely as necessary to operate, secure, and improve the Service and to comply with law. We do not claim ownership of your Output.

6. Subscriptions, Credits, and Payments

Payments. Paid plans are billed through our authorized reseller and Merchant of Record, Paddle (Paddle.com Market Limited). Paddle handles the order, payment, taxes, and receipts, and your purchase is also subject to Paddle’s Buyer Terms. Refunds and cancellations are described in our Refund & Cancellation Policy.

Billing and renewal. Subscriptions are billed in advance on a recurring basis (e.g., monthly or annually) according to the plan you select on our Pricing page. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. Prices may change; we will give reasonable notice of any change before it applies to you.

Credits. The Service operates on a credit system. Credits are a limited, revocable license to access generation features and have no monetary value, cannot be exchanged for cash, and are non-refundable and non-transferable except where required by law. Active subscribers receive a recurring credit allotment based on their plan, as shown on the Pricing page, distributed each billing period while the subscription remains active. As a general guide, one image costs one credit and video generation costs more (our most affordable video model starts at 150 credits per clip); exact costs vary by model.

Credit changes. We may change the credit cost of any feature, tool, or model, and may modify the number of credits allocated to any plan, at any time. Unused credits do not roll over between billing periods unless expressly stated. Credits expire when your subscription ends.

Feature and model availability. We may add, modify, or remove specific features, tools, or AI models (including specific model versions) at any time without prior notice. The availability of any particular functionality is not guaranteed.

Promotional credits. We may grant additional or bonus credits (for example, during a free trial or promotion). Promotional credits are discretionary, are not guaranteed, cannot be claimed as an entitlement, and do not establish a permanent baseline. Returning to standard allotments after a promotion does not constitute a refund event, false advertising, or a breach of these Terms.

“Unlimited” claims.Where we describe access as “unlimited,” we mean the absence of daily timers or usage cooldowns while a model is active — not infinite free generations. All generations consume credits at the then-current rates, and continued use after your allotment is exhausted requires purchasing additional credits.

Pricing and savings displays. Any discount or savings percentage shown in the Service is an illustrative comparison (for example, annual vs. monthly billing) intended to demonstrate value and may not reflect every plan shown on a given screen.

Fair use. To protect service stability for all users, we may apply reasonable fair-use limits, rate limits, or generation caps.

Credit and billing disputes. For any issue relating to credit balances, failed generations, or billing discrepancies, please contact support@genimage.art within 14 days of the issue so we can investigate.

7. Platform-Specific Subscriptions

A subscription purchased on this website applies only to your use of the Service on the web. It does not automatically grant access to any separate GenImage application distributed through the Apple App Store, Google Play, or other platforms, and a subscription purchased on iOS, Android, or another platform does not automatically grant access on the web. Each platform is billed and managed separately. If we choose to extend access across platforms, any such cross-platform access is provided on a complimentary, discretionary basis and may be changed or withdrawn at any time.

8. No Affiliation with Third-Party Platforms

GenImage is an independent service and is not affiliated with, associated with, authorized by, endorsed by, or officially connected to Midjourney, OpenAI (DALL·E), Google, or any other third-party platform. Any references to such platforms are illustrative only — to help describe the type or quality of results you can expect — and do not imply any partnership, endorsement, or shared technology. All trademarks and brand names are the property of their respective owners.

9. Intellectual Property

The Service, including its software, design, text, and branding (but excluding your Input and Output), is owned by GenImage or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without our prior written consent.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that Output will be accurate, reliable, or suitable for any purpose. AI-generated content may contain errors or unexpected results.

11. Limitation of Liability

To the fullest extent permitted by applicable law, GenImage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, resulting from:

  • your use of, or inability to use, the Service;
  • any unauthorized access to or use of our servers or any information stored on them;
  • any interruption or cessation of the Service;
  • any loss of credits or virtual currency resulting from technical errors, account termination, or service updates;
  • the removal or deprecation of any model or feature you previously relied upon; or
  • the accuracy, quality, or reliability of any images or videos generated by the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless GenImage and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your Input or Output, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, or to protect the Service, other users, or third parties. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing Law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised “Last updated” date and, where required, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
